重要なキーワード
イギリスの都市計画を理解する上で重要なキーワードを概説する。 詳細な説明はまた後述する。
- material - イギリス都市計画法では、material または materially という単語がたびたび登場する。 形容詞の material には 1. denoting or consisting of physical objects rather than the mind or spirit, 2. significant; important (Oxford Dictionary Online) という意味があるが、都市計画法においては 2 の用法である。 (小川祐之の博士論文では material は「関連する」という訳語が当てられている。)
- material consideration - 1990年法の section 70(2) と 54A に登場。地方計画局 (local planning authority) が、開発許可の行う際に考慮すべきすべての consideration。
- material change in the use - 用途の重要な変更。開発許可の対象になる。
- development - 1990年法の Section 55 と Section 336(1) に定義される。建物の一部の用途変更も development であり、開発許可を必要とする。
material consideration
"material considerations" は、1990年法の Section 70(2) と Section 54A に書かれている。
Section 70(2) によると、地方開発局は、「他の material consideration にない限り、 development plan に基づき開発許可申請に対処する」 とある。 すなわち、 material consideration が重要になる。
Stringer v Minister of Housing & Local Government [1970] 1 WLR 1281, Cook, J. によると、material consideration は 都市計画の性質を有し、土地の用途や開発に関わるいかなる consideration も都市計画の consideration となる、と述べている。
Planning Policy Guidence Notes (PPG) や Planning Policy Statements (PPS) は material consideration であるし、PPSでは他の多くの material consideration を規定している。 また、CABE による Design Review や Design Code なども material consideration となっている。 日本の研究で「デザインレビューには法的拘束力はない」という説明だけして、「デザインレビューは material consideration である」という説明がないものが見られるが、説明不足と言わざるを得ない。
日本では、「イギリスの都市計画は裁量性が高い」と説明されることがあるが、その法的根拠は material consideration という形態で得られているのである。
development
"development" は、1990年法の Section 55 と Section 336(1) に定義されている。 S. 55(1) によると、development には以下の２つの形態があるという。すなわち、 "the carrying out of building, engineering, mining or other operations in, on over or under land" または "the making of any material change in the use of any buildings or other land" である。
建物または土地の用途については、まずは Use Classes Order に規定がされている。 ここに規定されている use が変わる際には、development と見なされ、開発許可が必要である。
ただし、ここに書かれていないことでも、 material change と見なされることはある。 一例として Wallington v. Secretary of State for Wales (1990) 62 P & CR 150 がある。 これは、ペットとして飼っていた犬の数が増えたため、 material change of use すなわち開発であると見なされたケースである。 なお、この判決では、犬は６頭までは開発と見なさないという判決が出ている。 ゴミについては S. 55 で the deposit of refuse or waste materials on land involves a material change とあるので、 日本のゴミ屋敷などはイギリスでは開発と見なされかねない。
